Terms of Service
Effective Date: June 10, 2026 · Last updated: October 3, 2026
1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Victory Home Services, LLC (“Victory,” “we,” “us,” or “our”) governing your access to and use of the Victory Home Services platform (the “Platform”). By creating an account, clicking “I agree,” or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms.
If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Platform.
2. Platform Description
Victory is an online marketplace platform that connects homeowners and property managers (“Customers”) with independent home service professionals (“Vendors”). Victory facilitates the connection, booking, and payment process but does not directly provide home services.
Victory is not a contractor, staffing agency, or employer of Vendors. All services are performed by independent third-party contractors who have agreed to list their services on the Platform.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts to use the Platform. By registering, you represent that all information you provide is accurate and complete. Victory reserves the right to suspend or terminate accounts for false or misleading information.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@victoryhomeservices.net of any unauthorized access or security breach. Victory is not liable for losses resulting from unauthorized account use caused by your failure to secure your credentials.
4A. Text Messaging & Notifications
By providing your phone number or opting into alerts, you consent to receive transactional and account-related text messages from Victory Home Services (e.g., booking confirmations, reminders, and security alerts). Message and data rates may apply. Message frequency varies.
To opt out of marketing texts, reply STOP at any time. A STOP request is permanent across calls, texts, and email unless you later re-subscribe in writing. For help, reply HELP or contact us at legal@victoryhomeservices.net.
In-app, email, and push notifications are on by default. You can turn off any category at any time from Settings > Privacy & Notifications. Turning a category off stops future messages in that category; it does not unsubscribe transactional messages required to service your account.
5. Platform Fees and Payments
5.1 Customer Payments
Customers pay for services through the Platform via credit/debit card processed by Stripe, Inc. All prices are displayed in U.S. dollars. Payment is collected at the time of booking.
5.2 Platform Fee
Victory charges a platform service fee on each transaction. This fee is deducted from the total amount paid by the Customer before the remainder is remitted to the Vendor (“Vendor Payout”). The applicable fee percentage is displayed in each Vendor's account settings. By listing on the Platform, Vendors agree to Victory's then-current fee schedule.
Victory uses this fee to operate the Platform, provide payment processing, customer support, marketing, and insurance against qualified disputes.
5.3 Vendor Payouts
Vendor Payouts are processed via Stripe Connect. Vendors must complete Stripe's identity verification and connect a valid bank account to receive payouts. Payouts are processed on a weekly basis (every Monday) for completed jobs. Victory reserves the right to withhold payouts pending resolution of disputes, chargebacks, or policy violations.
5.4 Refunds and Cancellations
Customers may cancel a booking up to 24 hours before the scheduled service time for a full refund. Cancellations within 24 hours of the service may incur a cancellation fee of up to 50% of the service cost. Refunds are processed within 5-10 business days. Victory reserves the right to issue refunds or credits at its discretion in cases of unsatisfactory service.
6. Independent Contractor Relationship
⚠️ IMPORTANT: Vendors on the Victory platform are independent contractors, not employees, agents, partners, or joint venturers of Victory Home Services, LLC.
Vendors set their own rates, schedules, and service areas. Victory does not control the means or methods by which Vendors perform services. Vendors are solely responsible for:
- Proper licensing, permits, and certifications required in their jurisdiction.
- Maintaining adequate general liability insurance.
- Compliance with all applicable local, state, and federal laws.
- All taxes on income earned, including self-employment tax.
- Quality of services rendered to Customers.
Victory does not provide workers' compensation, unemployment insurance, health benefits, or any other employment benefits to Vendors. Nothing in these Terms creates an employment relationship.
6.1 Tax Obligations
Vendors acknowledge that Victory is required to report earnings of $600 or more per calendar year to the IRS via Form 1099-NEC. Vendors are responsible for paying all applicable federal and state income taxes, including self-employment tax (15.3%), on amounts received through the Platform. Victory does not withhold taxes from Vendor Payouts. Consult a qualified tax professional for guidance on your tax obligations.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Circumvent the Platform to avoid fees (including arranging direct payments with Vendors/Customers met through Victory).
- Post false, misleading, or fraudulent reviews, listings, or information.
- Harass, threaten, or discriminate against other users.
- Attempt to gain unauthorized access to any part of the Platform or its systems.
- Scrape, copy, or reproduce Platform content without written permission.
- Use automated tools (bots, scrapers) to access or collect data from the Platform.
8. Intellectual Property
The Platform and all content, features, and functionality are owned by Victory and are protected by copyright, trademark, and other intellectual property laws. You may not use Victory's name, logo, or trademarks without prior written consent.
By submitting content to the Platform (reviews, photos, business descriptions), you grant Victory a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and promoting the Platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VICTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including loss of profits, data, or goodwill, arising from your use of the Platform or any services booked through it. Victory's total liability to you for any claim shall not exceed the greater of (a) the amount you paid to Victory in the 12 months preceding the claim, or (b) $100.
Victory does not guarantee the quality, safety, or legality of services provided by Vendors. Customers engage Vendors at their own risk. Victory is not a party to any contract between a Customer and Vendor.
10. Indemnification
You agree to indemnify, defend, and hold harmless Victory, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Platform; (c) any services you provide or receive through the Platform; or (d) your infringement of any third-party rights.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
Consumer Reporting Agency: Our rights and obligations under this arbitration provision shall inure to the benefit of any consumer reporting agency (including Checkr, Inc.) whether or not such agency is named as a co-defendant in any proceeding.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be resolved on an individual basis.
Governing Law: These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any court proceedings shall be brought in Travis County, Texas.
12. Background Checks & FCRA Rights
This section applies to Vendors and any other users who undergo a background check in connection with the Platform.
12.1 Background Check Requirement
As a condition of listing services on the Platform, all Vendors must authorize and pass a background check conducted by Checkr, Inc. (“Checkr”), a consumer reporting agency located at 1 Montgomery Street, Suite 2000, San Francisco, CA 94104 | checkr.com.
Background checks may include: SSN trace and identity verification, national criminal records search, sex offender registry search, and global watchlist screening. The background check is conducted for the sole purpose of evaluating your suitability as an independent service professional on the Platform (“employment purpose” as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.).
12.2 FCRA Disclosure & Authorization
A consumer report and/or investigative consumer report may be obtained about you for platform access purposes. This is a standalone disclosure as required by the Fair Credit Reporting Act (“FCRA”). By completing the background check authorization during onboarding, you:
- Authorize Victory and Checkr to procure a consumer report about you;
- Acknowledge that this authorization may be used for any future background checks required during your time on the Platform;
- Certify that all information you provide is accurate and complete.
A copy of the full Background Check Disclosure is available at victoryhomeservices.net/background-check-disclosure.
12.3 Vendor Insurance Requirement
All Vendors must maintain general liability insurance with a minimum of $1,000,000 per occurrence while active on the Platform. Vendors must upload a current Certificate of Insurance (COI) during onboarding and must provide an updated COI upon expiration. Victory reserves the right to deactivate any Vendor whose insurance lapses.
Victory is not responsible for damages, injuries, or losses caused by Vendors. Vendors are independent contractors who are solely liable for their work. Victory's role is limited to facilitating the connection between Customers and Vendors.
12.4 Adverse Action Procedure
If Victory takes an adverse action (denying, suspending, or restricting your access) based wholly or in part on information in a consumer report, we will:
- Pre-adverse action notice: Provide you with a copy of the consumer report and a written description of your rights under the FCRA before taking action;
- Waiting period: Allow you at least 5 business days to review and dispute any inaccurate information;
- Final adverse action notice: If we proceed, we will notify you in writing, identify Checkr as the reporting agency, and inform you of your right to obtain a free copy of the report within 60 days and to dispute its accuracy.
12.5 Your FCRA Rights
You have the following rights under federal law:
- The right to know what is in your consumer report file;
- The right to request a free copy of your report from Checkr within 60 days of an adverse action;
- The right to dispute inaccurate or incomplete information directly with Checkr;
- The right to have inaccurate information corrected or deleted;
- The right to seek damages from violators of the FCRA in state or federal court.
A full summary of your rights is available at victoryhomeservices.net/fcra-rights and from the Consumer Financial Protection Bureau at consumerfinance.gov.
12.6 Report Use Limitation
Consumer reports obtained through the Platform are used solely to evaluate your eligibility as a Vendor. Reports are used one time for initial screening purposes only and are not shared with Customers or third parties except as required by law. Victory securely disposes of consumer report data when it is no longer required for legal or compliance purposes.
13. Termination
Victory reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account by contacting us at legal@victoryhomeservices.net. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect, including Sections 6, 8, 9, 10, 11.
14. Changes to Terms
Victory may update these Terms from time to time. We will provide notice of material changes via email or through the Platform. Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. Current version date: June 10, 2026.
15. Victory Mobile App
The Victory mobile app (Android) is an extension of the Platform. Your account, posts, and profile are shared between the website and the app, and these Terms apply to your use of the app.
The app collects the data described in our Privacy Policy (contacts, precise location, camera/microphone, push notifications, and usage/viewing analytics) from your first session, as disclosed in the app's own Terms of Service & Privacy Policy (version 2026-10-03) shown at first launch. The app requests each device permission the first time it is needed; you may grant or deny it and change your choice at any time in the app under Profile > Settings or in your phone's Settings.
