Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Victory Home Services, LLC(“Victory,” “we,” “us,” or “our”) governing your access to and use of the Victory Home Services platform (the “Platform”). By creating an account, clicking “I agree,” or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms.
If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Platform.
2. Platform Description
Victory is an online marketplace platformthat connects homeowners and property managers (“Customers”) with independent home service professionals (“Vendors”). Victory facilitates the connection, booking, and payment process but does not directly provide home services.
Victory is not a contractor, staffing agency, or employer of Vendors. All services are performed by independent third-party contractors who have agreed to list their services on the Platform.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts to use the Platform. By registering, you represent that all information you provide is accurate and complete. Victory reserves the right to suspend or terminate accounts for false or misleading information.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@victoryhomeservices.net of any unauthorized access or security breach. Victory is not liable for losses resulting from unauthorized account use caused by your failure to secure your credentials.
5. Platform Fees and Payments
5.1 Customer Payments
Customers pay for services through the Platform via credit/debit card processed by Stripe, Inc. All prices are displayed in U.S. dollars. Payment is collected at the time of booking.
5.2 Platform Fee
Victory charges a platform service feeon each transaction. This fee is deducted from the total amount paid by the Customer before the remainder is remitted to the Vendor (“Vendor Payout”). The applicable fee percentage is displayed in each Vendor's account settings. By listing on the Platform, Vendors agree to Victory's then-current fee schedule.
Victory uses this fee to operate the Platform, provide payment processing, customer support, marketing, and insurance against qualified disputes.
5.3 Vendor Payouts
Vendor Payouts are processed via Stripe Connect. Vendors must complete Stripe's identity verification and connect a valid bank account to receive payouts. Payouts are processed on a weekly basis (every Monday) for completed jobs. Victory reserves the right to withhold payouts pending resolution of disputes, chargebacks, or policy violations.
5.4 Refunds and Cancellations
Customers may cancel a booking up to 24 hours before the scheduled service time for a full refund. Cancellations within 24 hours of the service may incur a cancellation fee of up to 50% of the service cost. Refunds are processed within 5-10 business days. Victory reserves the right to issue refunds or credits at its discretion in cases of unsatisfactory service.
6. Independent Contractor Relationship
⚠️ IMPORTANT: Vendors on the Victory platform are independent contractors, not employees, agents, partners, or joint venturers of Victory Home Services, LLC.
Vendors set their own rates, schedules, and service areas. Victory does not control the means or methods by which Vendors perform services. Vendors are solely responsible for:
- Proper licensing, permits, and certifications required in their jurisdiction.
- Maintaining adequate general liability insurance.
- Compliance with all applicable local, state, and federal laws.
- All taxes on income earned, including self-employment tax.
- Quality of services rendered to Customers.
Victory does not provide workers' compensation, unemployment insurance, health benefits, or any other employment benefits to Vendors. Nothing in these Terms creates an employment relationship.
6.1 Tax Obligations
Vendors acknowledge that Victory is required to report earnings of $600 or more per calendar year to the IRS via Form 1099-NEC. Vendors are responsible for paying all applicable federal and state income taxes, including self-employment tax (15.3%), on amounts received through the Platform. Victory does not withhold taxes from Vendor Payouts. Consult a qualified tax professional for guidance on your tax obligations.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Circumvent the Platform to avoid fees (including arranging direct payments with Vendors/Customers met through Victory).
- Post false, misleading, or fraudulent reviews, listings, or information.
- Harass, threaten, or discriminate against other users.
- Attempt to gain unauthorized access to any part of the Platform or its systems.
- Scrape, copy, or reproduce Platform content without written permission.
- Use automated tools (bots, scrapers) to access or collect data from the Platform.
8. Intellectual Property
The Platform and all content, features, and functionality are owned by Victory and are protected by copyright, trademark, and other intellectual property laws. You may not use Victory's name, logo, or trademarks without prior written consent.
By submitting content to the Platform (reviews, photos, business descriptions), you grant Victory a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and promoting the Platform.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VICTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including loss of profits, data, or goodwill, arising from your use of the Platform or any services booked through it. Victory's total liability to you for any claim shall not exceed the greater of (a) the amount you paid to Victory in the 12 months preceding the claim, or (b) $100.
Victory does not guarantee the quality, safety, or legality of services provided by Vendors. Customers engage Vendors at their own risk. Victory is not a party to any contract between a Customer and Vendor.
10. Indemnification
You agree to indemnify, defend, and hold harmless Victory, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Platform; (c) any services you provide or receive through the Platform; or (d) your infringement of any third-party rights.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be resolved on an individual basis.
Governing Law: These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any court proceedings shall be brought in Travis County, Texas.
12. Termination
Victory reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account by contacting us at legal@victoryhomeservices.net. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect, including Sections 6, 8, 9, 10, 11.
13. Changes to Terms
Victory may update these Terms from time to time. We will provide notice of material changes via email or through the Platform. Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. Current version date: January 1, 2026.
